SECTION 1: PARTIES TO THE AGREEMENT

SECTION 2: SUMMARY OF TERMS AND ACCOUNT CHARGES; RECURRING DUES MEMBERSHIP BASICS

As a recurring dues member, you are agreeing to pay for your Broken Doll Studio membership on a recurring basis.

If your recurring dues membership is for a term of one month or less, then you have a month-to-month membership. You may cancel your month-to-month membership at any time with a 30-day advance written notice.

If your recurring dues membership is for a term greater than one month, then you have a 12-month Term Membership. A 12-Month Term Membership requires a full 12-month minimum commitment, and - unless cancelled as described in this Agreement - will automatically renew for an additional 12-month term. Except for disability, death, or relocation as described in Section 5, a 12-Month Term Membership may not be cancelled during the 12-month term without paying an Early Termination Fee equal to 50% of the remaining membership dues owed for the rest of the term. You may avoid renewal by providing a written cancellation notice at least 30 days before the end of your 12-month term.

Your recurring dues will begin on the same calendar date one (1) month after your initial payment and will continue on the same day each month thereafter until you cancel your membership per the terms of this Agreement.

You expressly authorize Broken Doll Studio, or its authorized billing services provider, to draft your account each month for any dues, fees, and charges.

• A month-to-month membership (no minimum term; cancel anytime with 30-day written notice); or

PRICING ADJUSTMENTS

• Month-to-Month Memberships:
Broken Doll Studio may adjust pricing for month-to-month memberships at its discretion. Members will receive a minimum of 30 days’ advance written notice before any pricing change takes effect.

• 12-Month Term Memberships:
The membership rate agreed upon at the start of the 12-month Term is locked for the full 12-month period. Broken Doll Studio reserves the right to update or adjust pricing for 12-Month Term Memberships at any time; however, any price changes apply only to new contracts and do not affect the price of an active 12-month Term until the end of its initial term.

OTHER CHARGES/FEES

No-Show/Late Cancel Fee (classes):

Standard: $20 for 75-minute classes; $25 for 90-minute classes

Chronic Illness Members: $15 for 75-minute classes; $20 for 90-minute classes

Open Pole Late Cancel/No-Show Fee:

Standard: $15 per session

Returned or Failed Payment Fee:

$25 for each transaction returned or declined for insufficient funds, expired cards, or other payment issues.

Class packs, open pole packs, and single drop-in purchases are paid in full at the time of purchase and are not subject to recurring billing or automatic renewal. These purchases are governed by the cancellation and late-cancel policies outlines in Section 8 of this Agreement.

SECTION 3: CONSENT TO AUTO-RENEWAL

MONTH-TO-MONTH MEMBER: I understand that my membership will continue to renew monthly until I properly cancel. Proper cancellation requires me to provide Broken Doll Studio with a 30-day advance written notice of cancellation, and that I will be expected to pay all dues, fees, and charges associated with my account. 

12-MONTH TERM MEMBERS:
I understand that my Term Membership includes a minimum contract commitment of twelve (12) months, during which I agree to maintain my membership in good standing and pay all monthly dues as scheduled.

If I choose to cancel before completing the 12-month term, I agree to pay an Early Termination Fee equal to 50% of the remaining membership dues owed for the rest of the term, unless my cancellation qualifies under the disability, death, or relocation protections described in Section 5 of this Agreement.

I understand that my 12-Month Term Membership will automatically renew for an additional 12-month term at the same rate unless I provide Broken Doll Studio with written notice of cancellation at least 30 days prior to the end of my current 12-month term.

If my membership renews for a new 12-month term, I agree to be bound by the same terms, conditions, dues, obligations, and early termination fee provisions as set forth in this Agreement.

Members are solely responsible for monitoring their upcoming renewal dates and ensuring timely cancellation if they do not wish to renew.

SECTION 4: NOTICE TO CUSTOMER

YOU ARE ENTITLED to a copy of the contract at the time you sign it. 

WORKSHOPS/SPECIAL EVENTS. Due to limited capacity and preparation, workshop and special-event purchases are final sale. A ticket may be transferred to another person with written notice at least 24 hours in advance.

SECTION 5: RECISSION CANCELLATION POLICIES; REFUNDS

RECISSION RIGHTS. You may cancel this contract at any time before midnight of the third operating day after receiving a copy of this contract. If you choose to cancel this contract, you must either: deliver notice to business in person or via email. If you cancel this contract within the three-day period, you are entitled to a full refund of your money. If the third operating day falls on a Sunday or holiday, notice is timely given if it is delivered or emailed as specified in this notice on the next operating day. Refunds must be made within 30 operating days of receipt of the cancellation notice by Broken Doll Studio. “Operating day” means any calendar day on which patrons may inspect and use the services of Broken Doll Studio during a period of at least four (4) hours.

CANCELLATION RIGHTS. After expiration of the three-day recission period, you may cancel this Agreement only if you qualify as follows:

You are disabled or you die. If, by reason of death or permanent disability, you are unable to receive all services for which you contracted, then you or your estate my cancel this Agreement without penalty and receive a pro rata refund, where applicable, for any prepaid sums. A “permanent disability” means a condition which completely prevents you from using the studio. Broken Doll Studio reserves the right to have your permanent disability verified by a physician. Broken Doll Studio shall retain the value for services already provided prior to your death or the onset of permanent disability.

You move. If you move more than 25 miles from the studio, then you may cancel this Agreement without penalty and receive a pro rata refund, where applicable, for any prepaid sums.

The Broken Doll Studio closes or relocates. If the studio closes, or if the studio relocates more than 25 miles from its original location, then you may cancel this Agreement without penalty and receive a pro rata refund for any prepaid sums

TERMINATION OF RECURRING DUES MEMBERSHIP. If you are a month-to-month member, you may terminate this Agreement at any time by providing Broken Doll Studio with a 30‐day advance written notice. There is no early termination fee for a month-to-month membership. If you are a Term member (including 12-month contract members), unless you rescind or cancel your membership for one of the reasons stated above, you may still cancel your membership with a 30-day advance written notice; however, you will be required to pay an early termination fee equal to fifty percent (50%) of the remaining membership dues owed for the rest of your initial term.

To avoid your 12-month Term membership automatically renewing for another 12-month term, you must provide Broken Doll Studio with written notice of cancellation at least 30 days prior to the end of your initial 12-month term.

If your Term membership automatically renews for another 12-month term, you may cancel at any time thereafter with a 30-day advance written notice, and no early termination fee will apply once you are in the renewed term.

Whether you are a month-to-month or Term member, once Broken Doll Studio receives your written notice of cancellation, your membership will remain active until the expiration of your then-current billing cycle.

REFUNDS. If you properly rescind or cancel your membership, Broken Doll Studio will "turn off" the EFT/ACH draft on your account and you will not be charged a penalty or early termination fee. Any refund due, if any, will be paid to you within 30 days.

SECTION 6: AUTHORIZATION FOR PREAUTHORIZED PAYMENT

By signing this Agreement, I am preauthorizing Glofox (powered by Stripe) (“Glofox"), a third party billing company located at 5th Floor, Marine House, Clanwilliam Court, Dublin 2, Ireland, D02 CV61 to initiate transfers, whether by credit/debit card or electronic funds transfer (ACH), from the designated bank account tied to this Agreement for purposes of billing all or a portion of the dues, fees and/or charges which I owe under the Agreement. I acknowledge and understand that: (a) dues, fees and charges include, but may not be limited to, enrollment fees, membership dues, service charges, late fees, applicable taxes, fees for uncollected monthly due, and, where applicable, any early termination fee owed under a Term membership; (b) Glofox may bill my designated account for any retail transactions or online purchases initiated by me; (c) dues, fees and charges will be drawn on or about the dates set forth in the Payment Schedule listed above in Section 2; (d) disclosures and rights concerning electronic funds transfers (EFTs) are available at www.glofox.com ; (e) this preauthorization will remain in effect until all of my payment obligations under the Agreement have been satisfied; (f) charges will appear under the prefix "BROKENDOLLSTUDIO" followed by my studio’s [name, phone number and state]; (g) debited amounts may vary each month based on additional amounts which I may owe under this Agreement, and that while I am entitled to receive notice at least 10 days before being charged, by signing this authorization, I am choosing instead to get notice only when the amount due would differ by more than $50.00 from my most recent payment; (h) my designated account shall only be used in compliance with my financial institution’s requirements; and (i) billing inquiries can be directed to [NAME] at [PHONE NUMBER]. This preauthorized payment arrangement shall apply to the applicant listed below.

SECTION 7: RELEASE OF LIABILITY; ASSUMPTION OF RISK; INDEMNITY

USING BROKEN DOLL STUDIO’S FACILITY INVOLVES THE RISK OF INJURY TO YOU OR YOUR GUEST(S), WHETHER YOU OR SOMEONE ELSE CAUSES IT. SPECIFIC RISKS VARY FROM ONE ACTIVITY TO ANOTHER AND THE RISKS RANGE FROM MINOR INJURIES TO MAJOR INJURIES, SUCH AS CATASTROPHIC INJURIES INCLUDING DEATH. IN CONSIDERATION OF YOUR PARTICIPATION IN THE ACTIVITIES OFFERED BY BROKEN DOLL STUDIO, YOU UNDERSTAND AND VOLUNTARILY ACCEPT THIS RISK AND RELEASE BROKEN DOLL STUDIO AND EACH OF THEIR RESPECTIVE AFFILIATES, AND EACH OF THE OWNERS, OFFICERS, DIRECTORS, EMPLOYEES, VOLUNTEERS, AGENTS AND INDEPENDENT CONTRACTORS THEREOF (THE"RELEASEES"), FROM ALL LIABILITY FOR ANY INJURY, INCLUDING, WITHOUT LIMITATION, PERSONAL, BODILY, OR MENTAL INJURY, ECONOMIC LOSS, OR ANY DAMAGE TO YOU, YOUR SPOUSE, GUESTS, UNBORN CHILD, OR RELATIVES, RESULTING FROM YOUR USE OF BROKEN DOLL STUDIO, INCLUDING ANY INJURY RELATING TO THE ORDINARY OR GROSS NEGLIGENCE, ACTUAL OR PASSIVE, OF THE RELEASEES OR ANYONE ACTING ON THE RELEASEES BEHALF OR ANYONE USING BROKEN DOLL STUDIO FACILITIES, WHETHER RELATED TO EXERCISE OR NOT. IN CONSIDERATION OF YOUR BEING ABLE TO PARTICIPATE IN BROKEN DOLL STUDIO ACTIVITIES, YOU AGREE TO INDEMNIFY, DEFEND AND HOLD THE RELEASEES HARMLESS AGAINST ANY LIABILITY, DAMAGES, DEFENSE COSTS, INCLUDING ATTORNEYS' FEES, AND ANY OTHER COSTS INCURRED IN CONNECTION WITH CLAIMS FOR BODILY INJURY, WRONGFUL DEATH OR PROPERTY DAMAGE CAUSED BY YOUR NEGLIGENCE OR OTHER ACTS OR OMISSIONS. YOU FURTHER AGREE TO HOLD HARMLESS, DEFEND AND INDEMNIFY THE RELEASEES FROM ALL LIABILITY, DAMAGES, DEFENSE COSTS, INCLUDING ATTORNEYS' FEES, AND ANY OTHER COSTS INCURRED IN CONNECTION WITH CLAIMS FOR BODILY INJURY, WRONGFUL DEATH OR PROPERTY DAMAGE BROUGHT BY YOU, YOUR GUESTS, OR MINORS, EVEN IF THE RELEASEES WERE NEGLIGENT. FURTHER, YOU UNDERSTAND AND ACKNOWLEDGE THAT THE RELEASEES DO NOT MANUFACTURE FITNESS OR OTHER EQUIPMENT, BUT PURCHASE AND/OR LEASE EQUIPMENT. YOU UNDERSTAND AND ACKNOWLEDGE THAT THE RELEASEES AND BROKEN DOLL STUDIO ARE PROVIDING RECREATIONAL SERVICES AND MAY NOT BE HELD LIABLE FOR DEFECTIVE PRODUCTS. YOU ACKNOWLEDGE AND AGREE THAT YOU HAVE READ THE FOREGOING AND KNOW OF THE NATURE OF THE ACTIVITIES AT BROKEN DOLL STUDIO.

EXTERNAL COACHES. No outside coaching, teaching, or commercial instruction is permitted without prior written approval. Any approved coach must carry their own liability insurance (e.g., $1M/$2M), name Broken Doll Studio LLC as additional insured, provide a certificate of insurance, and sign a Studio-provided External Coach Agreement.

SECTION 8: MEDICAL CONDITIONS; USE OF BROKEN DOLL STUDIO; OTHER PROVISIONS

MEDICAL CONDITIONS. BEFORE USING BROKEN DOLL STUDIO’S SERVICES OR FACILITIES, YOU REPRESENT THAT YOU ARE IN GOOD HEALTH AND HAVE NO DISABILITY, IMPAIRMENT, INJURY, DISEASE, OR AILMENT, PREVENTING YOU FROM ENGAGING IN ACTIVE OR PASSIVE EXERCISE OR WHICH COULD CAUSE INCREASED RISK OF INJURY OR ADVERSE HEALTH CONSEQUENCES AS A RESULT OF EXERCISE. YOU ASSUME FULL RESPONSIBILITY FOR YOUR USE OF THE BROKEN DOLL STUDIO FACILITY AND SHALL INDEMNIFY BROKEN DOLL STUDIO, ITS AFFILIATES, AGENTS AND EMPLOYEES, AGAINST ANY AND ALL DAMAGES ARISING OUT OF YOUR USE OF THE FACILITIES. 

RULES, REGULATIONS AND SCHEDULES. All Broken Doll Studio members and their guests must abide by the rules, regulations and schedules of Broken Doll Studio, which
may be posted at the studio or issued orally, and which may be amended from time to time at Broken Doll Studio’s sole discretion. Upon joining, you must pay the appropriate initial charges. In Broken Doll Studio’s sole discretion, your membership may be revoked or suspended at any time if, in the judgment of Broken Doll Studio, (i) you, or your guests, consistently fail to observe the Rules and Regulations; (ii) you have otherwise behaved in a manner contrary to the best interests of Broken Doll Studio or any of Broken Doll Studio’s members or employees; (iii) you have instituted any type of legal action against Broken Doll Studio, including but not limited to civil actions, arbitrations and/or mediations; and/or (iv) Broken Doll Studio has instituted any type of legal action including, but not limited to civil actions, arbitrations and/or mediations against you.

LIMITATIONS ON AVAILABILITY.

It is to be expected that there may be occasional delays, especially during peak hours, in using the fitness equipment or that you may not always be able to attend a preferred exercise class. All members should schedule their desired classes in advance on the Broken Doll Studio app, or contact the Broken Doll Studio directly to schedule a class.

FREEZE POLICY.

If you are temporarily unable to use the Broken Doll Studio facility for medical reasons, you may request a freeze of your membership in monthly increments. A written doctor’s note is required at the time of the request, and you must complete and return a Membership Freeze Form to Broken Doll Studio. Freezing your membership pauses your access but does not pause your financial obligation under this Agreement; all remaining months of any Term membership must still be completed.

Any approved freeze will automatically extend the end date of your membership term by the length of the freeze, and all monthly dues will continue to be charged according to your original billing schedule until the extended term is fulfilled. A fee of $25 per month will be assessed for every month the membership is frozen.

Requests must be received at least fourteen (14) days prior to your next billing date. Retroactive freezes will not be accepted. Broken Doll Studio may adjust this policy at its sole discretion.

CHRONIC ILLNESS MEMBERS. If you have a chronic illness, you will need to fill out a Chronic Illness Waiver Form in order to be eligible for any applicable benefits of membership. Upon request, the Chronic Illness Waiver Form may be provided to you.

NO SHOW/LATE CANCEL FEE. Broken Doll Studio enforces clear and fair cancellation policies to maintain class and open pole availability and to respect the time of our instructors and members. Our No-Show and Late Cancellation fees and policies are as follows:

Standard Members

Cancellations for all classes and open pole sessions must be made at least 12 hours before the scheduled start time to avoid a penalty.

Classes

Late cancellations (within 12 hours) will incur a fee as follows:

$20 for 75-minute classes

$25 for 90-minute classes

No-shows (failure to attend without canceling) will result in loss of the class credit (for class-pack or membership users).

Open Pole

Late cancellations or no-shows for open pole sessions (60 minutes) will incur a $15 fee.

Members with unlimited open pole access who repeatedly no-show may have booking privileges temporarily suspended at the Studio’s discretion.

Chronic Illness Waiver Members

Members with an approved Chronic Illness Waiver may cancel up to 6 hours before class or open pole without penalty.

Classes

Late cancellations (within 6 hours of class) will incur a reduced fee:

$15 for 75-minute classes

$20 for 90-minute classes

No-shows will result in loss of the class credit (for class-pack or membership users).
Open Pole

Late cancellations or no-shows within 6 hours of the start time will incur a $10 fee.

Repeat No-Shows

Repeated no-shows or late cancellations—whether for classes or open pole—may result in suspension of booking privileges or membership review at Broken Doll Studio’s discretion. The Studio reserves the right to evaluate each case individually and take appropriate action as needed.

CHANGE IN MEMBERSHIP OR BILLING INFORMATION. You must promptly notify Broken Doll Studio in writing of any changes in your billing information, address or telephone number. You expressly permit Broken Doll Studio, or its authorized billing company, to obtain such updated information through payment card networks, card issuers or other third parties. Changes to billing information do not alter or shorten the remaining term of any 12-month Term membership. Any request to change, downgrade, or modify a membership type during a 12-month Term requires prior written approval from Broken Doll Studio and does not eliminate any remaining financial obligations under the Term.

DESCRIPTION OF SERVICES; HOURS OF ACCESS. Broken Doll Studio services are class based. In order to utilize Broken Doll Studio services or facilities, you must sign up for a class on‐line at www.brokendollstudio.com, or using the app. Your membership with Broken Doll Studio shall include access to the studio or studios to which you purchased. Subject to the class scheduling requirement, Broken Doll Studio intends to make available to all of its members and guests during its designated hours and days of operation the following equipment and services: pole fitness equipment and related cardiovascular, strength and conditioning equipment and apparatus. Broken Doll Studio provides group exercise classes and private training for member use. Some group exercise classes and optional services may require an additional charge. Broken Doll Studio reserves the right to revise its list of equipment and services at any time for any reason. Please see Broken Doll Studio management for a schedule of classes and hours of access to the studio.

PRIVATE TRAINING. Any and all private training provided by Broken Doll Studio shall be subject to the terms of this Agreement, as well as any additional terms and conditions set forth in a separate Private Training Addendum entered into between you and Broken Doll Studio. Use of private trainers not approved and employed by Broken Doll Studio is prohibited. You may not train other members or guests, conduct business activity or solicit any business at Broken Doll Studio.

OPEN POLE USE. Broken Doll Studio shall provide open pole sessions by appointment during designated hours. Open pole sessions are self-guided and non-instructional. Members shall warm up independently, employ spotting as necessary, use crash mats for advanced skills, and clean all equipment following use.

Private or informal training sessions are not permitted during open pole. Members may not use open pole time to instruct, coach, or train other members, guests, or individuals for compensation or otherwise.

While Broken Doll Studio welcomes independent practice, self-teaching is strongly discouraged for safety reasons. Members are encouraged to follow a structured program, such as an online curriculum, instructor-assigned coursework, or prior class material, to ensure safe progression. By participating in open pole, members acknowledge and assume all risks associated with self-guided practice.

INSTRUCTORS. Instructors are authorized to restrict or prohibit Member participation in any activity deemed unsafe for Member’s level or condition. Instructors shall provide safe guidance and spotting within the scope of their training.

CHANGE IN STUDIOS AND OPERATING HOURS. As a result of repair, maintenance, or special occasions, Broken Doll Studio may be required to restrict the use or temporarily close the studio or halt a Broken Doll Studio activity from time to time. There will be no reduction, suspension, abatement, or apportionment of membership fees or other charges during such time when the above-mentioned occurs. Broken Doll Studio’s hours of operation may be modified from time to time without prior notice to you. Broken Doll Studio reserves the right to change the studio from time to time, to eliminate or add studios and services, and to change the type or quantity of equipment and services. 

INTERRUPTION OF SERVICE. In case of a long‐term interruption of service (i.e. fire), Broken Doll Studio reserves the right to freeze membership and add the lost time once services resume. In the event that an act of God (i.e. hurricane, earthquake, national emergency, etc.), causes more than a temporary closure of the Broken Doll Studio facility, your obligations under this Agreement will be suspended until such time as use of the studio can be resumed and you may choose to suspend your membership or receive a refund of the unused portion of the membership term.

TEXT (SMS) MESSAGES. You give express written consent to Broken Doll Studio and its authorized service providers to contact you via text (SMS) at the cell phone number listed above for any matter related to your account, including collection of past due fees, as well as promotions, offers or other advertisements related to Broken Doll Studio’s products, facilities, or services.

IMAGE USE. You understand that while on Broken Doll Studio’s premises, your image (including live or recorded video images), may be used or shown on the Broken Doll Studio website or social media outlets (i.e. Facebook, Instagram, YouTube, etc.), and that by entering the premises you consent to the use of these images. You may opt out of your image use by providing a written notice to Broken Doll Studio or wearing a designated privacy wristband that may be obtained at the studio. You may record yourself with instructor permission during class, however, you are prohibited from recording other members in the class without their prior consent.

PRIVACY AND DATA PROTECTION. Broken Doll Studio shall use your personal data solely for operational, legal, or payment processing via third parties and shall not share such data without your consent except as required by law or court order. You may request access to, or updates of, personal data maintained by Broken Doll Studio at any time.

MEMBERSHIP TERMINATION. We reserve the right to terminate your membership for any reason not expressly prohibited by law. In the event of termination, we will notify you in person or send you a written notice of termination to your address on file and refund you any unused prepaid dues. If Broken Doll Studio terminates a 12-month Term membership, no early termination fee will be charged and your financial obligations under the Term will cease as of the effective termination date.

DISPUTE RESOLUTION (U.S.). OTHER THAN A CLAIM FOR PERSONAL INJURY, OR A CLAIM BROUGHT IN SMALL CLAIMS COURT, YOU AGREE THAT ANY DISPUTE WITH BROKEN DOLL STUDIO, INCLUDING ITS OFFICERS, DIRECTORS, EMPLOYEES AND AGENTS, WILL BE RESOLVED, FIRST, THROUGH INFORMAL DISCUSSIONS WITH BROKEN DOLL STUDIO; THEN, IF UNSUCCESSFUL, BY NON‐BINDING MEDIATION. IF A MEDIATOR CANNOT RESOLVE THE DISPUTE, THEN YOU AGREE TO WAIVE YOUR RIGHT TO A JURY TRIAL AND CONSENT TO BINDING FINAL JUDGMENT DECIDED BY A SINGLE JUDGE IN THE SUPERIOR COURT OF PIMA COUNTY IN TUCSON, ARIZONA. YOU AND BROKEN DOLL STUDIO FURTHER AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. YOU ALSO AGREE NOT TO PARTICPATE IN CLAIMS BROUGHT IN A PRIVATE ATTORNEY GENERAL OR REPRESENTATIVE CAPACITY, OR CONSOLIDATED CLAIMS INVOLVING ANOTHER PERSON’S ACCOUNT IF BROKEN DOLL STUDIO IS A PARTY TO THAT PROCEEDING.  IF YOU DO NOT WISH TO BE BOUND BY THIS DISPUTE RESOLUTION PROVISION, YOU MAY OPT OUT BY SENDING A WRITTEN NOTICE TO BROKEN DOLL STUDIO AT 3110 E FORT LOWELL ROAD, TUCSON AZ, 85716 WITHIN 90 DAYS AFTER THE DAY YOU SIGN THIS AGREEMENT. MEDIATION COSTS MUST BE SPLIT EQUALLY. ATTORNEY FEES AND COSTS SHALL BE BORN BY THE DEFEATED PARTY IN ANY MATTER BROUGHT BEFORE THE COURT.

STUDIO POLICIES. Attached to this Agreement is the Broken Doll Studio’s Community Policies. By signing this Agreement, you acknowledge that you have read and agree to abide by the rules and policies within.
ENTIRE AGREEMENT. Verbal agreements with a Broken Doll Studio employee, agent, representative or independent contractor will not be accepted as valid. Only this Agreement, and all rules and regulations of Broken Doll Studio, as revised from time to time, constitute the entire and exclusive agreement between you and Broken Doll Studio, and supersede all prior written and/or oral promises, representations, understandings and/or agreements relating to this membership purchase.
GOVERNING LAW. This Agreement shall be interpreted under the laws of the State of Arizona. Any litigation under this Agreement shall be resolved in the courts of the State of Arizona.
LIMITED LIABILITY. Unless controlling legal authority requires otherwise, any award by a court or arbitrator is limited to actual compensatory damages. Neither a court nor an arbitrator can award either party any indirect, special, incidental, consequential, or punitive damages, even if one party told the other party that they might suffer these damages.

BROKEN DOLL STUDIO COMMUNITY POLICIES

AGE REQUIREMENT: Participation in all classes, open pole, workshops, and events is limited to individuals 18 years or older.

INCLUSIVITY. Broken Doll Studio is a space where every member is respected and valued, regardless of race, ethnicity, religion, gender, and otherwise. Our organization is committed to creating and maintaining a welcoming, inclusive, and respectful environment for all members. By becoming a participating member in the Broken Doll community, you agree to treat everyone with dignity and respect, regardless of background or identity.

CODE OF CONDUCT. Broken Doll Studio maintains a zero-tolerance policy for harassment, bullying or discrimination on any basis, including but not limited to race, gender, gender identity, sexuality, disability, body size, religion or background. Violation of this policy may result in suspension or permanent termination of your membership without a refund. 

GUEST USE. Your guests are permitted to use the Broken Doll Studio facility, but only pursuant to such rules, regulations, fees, and schedules for guest use as then may be in effect. Broken Doll Studio reserves the right to limit the number of times any one guest can use the Broken Doll Studio facility and reserves the right to exclude any of your guests whose use of the studio, in the sole opinion of Broken Doll Studio, would be detrimental to Broken Doll Studio or any of its members or employees. All guests must complete a Guest Registration Form at the front desk with valid identification.

EQUIPMENT USE. By signing this agreement, you agree to (1) only use all poles and equipment only as instructed; (2) employ spotters and cash mats as directed by instructors; (3) remove all jewelry and avoid lotions or oils prior to class appointments; (4) clean poles and shared equipment following use; (5) immediately report any equipment damage; and (6) acknowledge that destruction of equipment or damage caused by misuse, negligence, or failure to follow Studio rules may result in member liability for repair or replacement costs.

SAFETY AND CONDUCT. Members are prohibited from participating at any Broken Doll Studio while under the influence of alcohol or drugs. 

Broken Doll Studio supports individual expression and encourages members to wear attire that fosters comfort and confidence. Notwithstanding the foregoing, for health, safety, and legal compliance purposes, all members and guests are required to keep nipples and genitalia fully covered at all times while on studio premises. Failure to comply with this requirement may result in removal from the premises and/or suspension or termination of membership privileges at the discretion of Broken Doll Studio.

PERSONAL PROPERTY. Members are solely responsible for securing all personal belongings following class. Broken Doll Studio is not liable for lost or stolen items.

RESTRICTED ACCESS. Members shall not enter staff-only areas or use Broken Doll Studio facilities outside designated hours without written authorization.
